By accessing or using mce.motu.art (the "Website") and its API (together, the "Service"), you accept and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.

• MotuArt Color Engine ("MCE") is an AI portrait skin-tone mapping and color-correction engine. Through the Website or the API, it accepts photos you upload and returns images with corrected color, white balance, and optional style grading applied.
• MCE uses machine-learning models (e.g. person/skin segmentation) to help identify people and skin regions so color adjustments can be applied locally. Model predictions can be imperfect and results are not guaranteed to meet expectations in every scenario.
• MCE only adjusts color, white balance, and texture. It does not swap faces, generate people who do not exist in the source image, or alter facial structure or identity.
• We do not use photos you upload to train unrelated third-party products or publicly released general-purpose models.

The Service is not intended for users under 18 years of age. If you are under 18, do not use the Service. Any party permitting minors to use the Service will be in breach of these Terms and access may be revoked at any time.

• Where the Service offers accounts or API keys, you must provide accurate, current, and complete information.
• You are responsible for safeguarding your credentials and API keys and must not share them with others. Notify us immediately of any unauthorized use.
• You are responsible for calls made and losses incurred due to a compromised key resulting from your failure to keep it secure.
• We may suspend or terminate accounts and keys at our discretion for violations of these Terms.

• We reserve the right to modify, suspend, or discontinue the Website/API or any feature (including the style library, processing limits, or quotas) at any time.
• We may restrict access to any part of the Service.
• If you use the Service through a team or organizational account, you are responsible for ensuring everyone accessing MCE through that connection complies with these Terms.

• The Website, API, engine code, style presets (LUTs/parameters), and other content are owned by LANMOON PTE. LTD. ("Company") or its licensors and are protected under Singaporean and international intellectual-property laws.
• You may temporarily cache content for access, and print/download a reasonable number of pages for personal use.
• You may not reproduce, distribute, or modify style presets or the Service itself (as opposed to your own processed output) for commercial resale or redistribution.
• All rights not expressly granted are reserved by the Company.

• You own the photos you upload ("Input Content") and the images produced ("Output Content"). You are solely responsible for having all rights necessary to upload a photo, including consent from any identifiable people in it.
• To provide the Service, you grant the Company a limited, non-exclusive license to temporarily store and process Input/Output Content solely to perform image processing, troubleshooting, and quality assurance.
• We will not use your Input or Output Content for marketing purposes except as required by law or with your consent.
• You may not upload photos of others that you do not have the right to process, or use the Service for harassment, defamation, or the sexual exploitation of minors.

• Violate applicable laws or exploit the Service in ways that harm minors.
• Impersonate any person or entity; send spam or unsolicited commercial messages.
• Disrupt or interfere with the Service (e.g. injecting malicious code, denial-of-service attacks, reverse-engineering the models).
• Circumvent processing limits, quotas, or rate limits.
• Process photos of third parties without their consent.

• We may, at our discretion, decline to process requests that violate these Terms.
• We may disclose relevant identity information to third parties asserting infringement claims, as required by law.
• We may terminate access for accounts/keys that violate these Terms.
• We cooperate with lawful requests from law-enforcement authorities.
• We have no obligation to pre-screen content you upload or generate and assume no liability for it.

• The Service is currently in Beta. If we introduce paid quotas or subscription plans, fees and quota details will be stated at the point of purchase.
• Payments for any paid plan are processed through a trusted third-party payment provider, subject to that provider's own terms.
• Except as required by Singapore law, fees already incurred are non-refundable.
• You are responsible for any taxes applicable to your use of the Service.

To report an infringement of your copyright, contact us at hi@motu.art with:

• your signature and contact details;
• identification of the infringed work(s);
• a statement of your good-faith belief that use is unauthorized.

The Service is provided "as is." We disclaim all warranties, express or implied, regarding accuracy, reliability, availability, or fitness of the output for your particular purpose. You use the Service, and rely on its output, at your own risk.

To the maximum extent permitted by law, the Company and its affiliates and licensors shall not be liable for any direct, indirect, or consequential damages arising from your use of the Service. The Company's aggregate liability is capped at the fees you actually paid for the Service in the 12 months preceding a claim.

You agree to indemnify the Company and its affiliates against claims arising from your breach of these Terms or misuse of the Service, including uploading photos of others without consent.

• Governing Law: the laws of Singapore, excluding its conflict-of-law principles.
• Jurisdiction: the exclusive jurisdiction of the courts of Singapore.

• Waiver: no waiver of any term is effective unless made in writing.
• Severability: if any provision is found invalid, the remaining provisions remain in effect.
• Amendments: revised Terms take effect immediately upon posting; continued use constitutes acceptance.
• Entire Agreement: these Terms together with the Privacy Policy constitute the entire agreement between you and the Company.

The Service is operated by LANMOON PTE. LTD. (Singapore).
